More time for tax returns and insolvency applications
Extension of deadlines for the suspension of the obligation to file for insolvency and for the filing of tax returns: The Federal Council has given the green light.
This article is part of the special topic: Restructuring, protective shield or insolvency?
On February 12, the Federal Council approved a further suspension of the obligation to file for insolvency until April 30, 2021. However, this only applies to companies that can expect to receive benefits from COVID-19 aid programs (November and December aid or bridging aid). A prerequisite is that the applications were submitted, or will be submitted, between November 1, 2020, and February 28, 2021 .
The insolvency must be caused by the COVID-19 pandemic. Therefore, the obligation to file for insolvency will not be suspended if the company has no prospect of receiving coronavirus aid or if the available aid is insufficient to eliminate the insolvency situation.
If no applications could or cannot be filed between November and the end of February for legal or IT-technical reasons, the obligation to file for insolvency will also be suspended for those companies that fall within the group of eligible applicants under the terms of the program.
Insolvency filing: Over-indebted or insolvent due to Corona? An expert explains in this article who does not currently have to file for insolvency despite pandemic-related financial problems.
Tax advisors get more time
The deadline for tax advisors to submit a tax return is being postponed by half a year: For the 2019 tax year, the deadline is now August 31, 2021 instead of the usual February 28.
At the same time, the grace period for waiving late payment interest on tax debts is being extended by six months. The reason for this one-time postponement: Tax advisors are currently extremely busy processing applications for the current COVID-19 relief programs for businesses.
