If an employee doubts that the employer has paid the social security contributions, his or her health insurance company must provide him or her with information about this.
If an employee has reasonable doubts that their employer is paying social security contributions correctly , they can request information from their health insurance provider. The insurer may not refuse this request.
The woman learned from former colleagues that her former employer had allegedly failed to pay social security contributions. She therefore called her health insurance provider to inquire whether this also applied to her case. However, the health insurance provider refused to provide this information, stating that this data could not be disclosed without the employer's consent.

The court sided with the insured persons. It ruled that they had a legal right to information about the social security data stored about them. The health insurance company was therefore obligated to inform its insured persons whether their employer paid social security contributions on their behalf. The employee share of the contributions was also paid from the employee's assets. Ultimately, this constituted the insured person's social security data.
