1. Scope and subject matter
These terms and conditions (hereinafter referred to as 'Terms and Conditions') apply to participation in the competition organized by Verlagsanstalt Handwerk GmbH, Auf'm Tetelberg 7, 40221 Düsseldorf, (hereinafter referred to as "Publishing House") for the prize draw of a STIHL GTA 30 in a set with 2 AS 2 batteries, AL 5-2 double fast charger and tool case. 
2. Participation
2.1 Any adult natural person may participate in the publishing house's competitions. Employees of the publishing house and its cooperation partners, as well as their relatives and persons living in the same household, are excluded from participation. 
2.2 Each participant may only enter the competition once in their own name. If you do not provide this information, participation in the competition will not be possible. By entering your personal data, you confirm that you wish to participate in the competition voluntarily and, if applicable, that you would like to receive the above-mentioned marketing materials in the future to the address provided below, and that you are the same person who sent the information.
2.3 Participation in the competition is free of charge. Participation is possible as follows: online at www.handwerksblatt.de/gewinnspiel
2.4 To participate in a competition, the participant must truthfully provide their name and, if necessary, other information required to conduct the competition (such as contact information). 
2.5 The opportunity to participate in the prize draw ends at the end of the entry period. The date of receipt by the publishing house is decisive. The prize draw runs from June 17th to July 31st, 2026, daily from 00:00 to 23:59. We are not responsible for technical errors in transmission unless they are due to our negligence.
3. Early termination and exclusion
3.1 The publishing house reserves the right to cancel or terminate a competition for good cause and while safeguarding the legitimate interests of the participants. This applies in particular if proper execution cannot be guaranteed for technical or legal reasons. In such a case, participants have no claims against the publishing house. 
3.2 The publishing house reserves the right to exclude participants from the competition. This applies in particular in the event of violations of the terms and conditions or if participants use manipulation or other dishonest means. The publishing house may also declare such exclusion retroactively, revoke prizes, and demand their return.
4. Determination and notification of the winner
4.1 The winners will be determined by the publishing house, its employees, agents, or commissioned third parties. Legal recourse is excluded.
4.2 The winners will be determined by random drawing.  
4.3 Participants identified as potential winners will be notified after the closing date via the contact information provided during the competition. This message does not constitute a notification of the prize within the meaning of Section 661a of the German Civil Code (BGB). If the publishing house knows the mailing address of a participant identified as a winner, the publishing house reserves the right to send the prize directly with the notification.
4.4 Each participant notified in accordance with Section 4.3 is obligated to inform the publishing house within one week of sending the notification whether they have accepted the prize. The right to receive the prize only comes into effect upon receipt of the confirmation or the subsequent notification of the winner from the publishing house. If the publishing house does not receive a response within the deadline, the opportunity to accept the prize expires, and the publishing house reserves the right to select another participant from the remaining participants as the potential winner and to notify them in accordance with Section 4.3. 
5. Prize and delivery of the prize
5.1. Prizes are described below. The prize shown, if any, is not necessarily identical to the actual prize. Deviations, particularly in model, color, features, etc., are possible.

1x STIHL GTA 30 in a set with 2 AS 2 batteries, AL 5-2 double fast charger and tool case (valid from 17.06. to 31.07.2026), value 329 EUR €.
5.2 Should the prize not be available for any reason whatsoever, the publishing house reserves the right to award a substitute prize of equal or higher value.
5.3 The prize is generally limited to the amount specifically stated in the terms and conditions. Postage costs for shipping the prize abroad are not included. Any (consequential) costs incurred by the winner during and/or through the use of the prize – e.g., for travel, accommodation, maintenance, or taxes – are not included.
5.4 Cash payment of the prize value or exchange of the prize is excluded. If the winner is unable to claim the prize (e.g., due to time constraints), it will be forfeited without compensation. The prize is non-transferable.
5.5 The prize may also be delivered or paid out by the publishing company's cooperation partners. In this case, the transfer of ownership takes place exclusively and directly between the cooperation partner and the winner. 
6. Limitation of liability and warranty
6.1 The publishing house shall be liable, regardless of the legal basis, without limitation in cases of intent and gross negligence. In cases of simple negligence, the publishing house shall only be liable
• for damages resulting from injury to life, body or health (personal injury),
• for damages resulting from the breach of a material contractual obligation; however, liability is then limited – with the exception of personal injury – to compensation for foreseeable, typically occurring damages. Material contractual obligations are obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer regularly relies and may rely.
The aforementioned limitations of liability do not apply if the publishing company has fraudulently concealed a defect or has provided a guarantee for the quality of the services. Our liability under the Product Liability Act also remains unaffected.
6.2 Claims for possible material and/or legal defects in prizes provided by the publishing company's cooperation partners must be asserted exclusively against these partners. The above also applies to claims for possible material and/or legal defects in services provided by third-party service providers as part of the prize redemption; these claims must be asserted exclusively against the respective service provider.
7. Data protection
7.1 To conduct competitions, participants must provide the publishing company with personal information, such as their name or contact details. Without this information, winners cannot be determined and prizes cannot be sent or distributed.  
7.2 The publishing house processes the personal data collected as part of the participation and/or prize processing solely for the purpose of conducting and processing the respective competition. For this purpose, the data may also be transferred to cooperation partners, service providers commissioned with the competition administration, or service providers involved in the prize processing. The legal basis for this processing is Art. 6 (1) (b) GDPR. The data will be deleted after the competition has been completed and after the statutory retention periods have expired.
7.3 We explain how the publishing house ensures data protection in our data protection declaration, which you can find at www.handwerksblatt.de/datenschutz. 
8. Miscellaneous
8.1 The conduct of competitions by the publishing house is governed by the laws of the Federal Republic of Germany. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular those of the country in which the participant, as a consumer, has their habitual residence, remain unaffected. The exclusive place of jurisdiction, to the extent permitted by law, is Düsseldorf.
8.2 Should any of the above provisions of these Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
