Equal treatment is getting an upgrade
People should be better protected from discrimination. Therefore, the German government has now presented a draft law that transposes EU regulations into German law.
The General Equal Treatment Act (AGG) is to be reformed to provide even better protection against discrimination. The German Federal Cabinet submitted a corresponding draft bill on May 6, 2026. This aims to incorporate European regulations into German law and expand the scope of protection.
The General Equal Treatment Act (AGG) has been in effect since 2006. It protects people from discrimination in the workplace and in private contracts such as rentals or purchases. With the new "Second Act Amending the AGG," the German government aims to strengthen protection for those affected, clarify unclear sections of the law, and improve the enforcement of rights .
The draft law presented on May 6, 2026 contains five key changes:
1. Longer period for claims
Those who experience discrimination should have more time to claim their rights. Currently, claims must be filed within two months. This period will be extended to four months.
2. More protection in everyday life
Protection against discrimination in civil law is to be expanded. Currently, it only applies to so-called mass transactions with regard to gender – this restriction is to be removed. The amendment implements the EU Unisex Directive and thus ends an ongoing infringement procedure by the European Commission.
Protection against sexual harassment is also being extended to everyday life : The General Equal Treatment Act (AGG) will apply not only in the workplace, but also in housing, at the gym, or at driving school. This will provide those affected with better legal protection in these settings as well.
3. More support from the anti-discrimination office
The Federal Anti-Discrimination Agency (ADS) is to be better equipped to help people who feel discriminated against. In the future, it will offer a dispute resolution procedure open to anyone who believes their rights under the General Equal Treatment Act (AGG) have been violated. The aim is a swift and amicable solution. Furthermore, the ADS will be authorized to act as an advocate in court proceedings or to provide statements at the court's request. Its cooperation with the Federal Government will also be more clearly regulated. These changes implement two EU directives on equal treatment bodies.
4. Adaptation of the "church clause"
The so-called "church clause" ( § 9 AGG ) allows religious communities to treat their employees differently depending on their religion or worldview – but only within certain limits. In the future, a clear connection between religion and the specific job or its circumstances must exist. In this way, the legislator is adapting the provision to the jurisprudence of the highest courts.
5. Easier application of the law
Additional clarifications and improvements are intended to make the General Equal Treatment Act (AGG) more understandable and practical. The discriminatory characteristic "age" will be replaced by "chronological age ." Furthermore, civil law protections during pregnancy and maternity will be strengthened.
