The tradesman must inform the customer that travel costs will be incurred before the contract is concluded. Otherwise, they cannot invoice them.
Disputes over travel expenses are something every business owner is familiar with. Previously, courts usually sided with the tradespeople. However, since 2014, Section 312a of the German Civil Code (BGB) introduces a still relatively unknown regulation: According to this section, businesses must disclose all costs before concluding a contract – otherwise, they cannot charge for them. This also applies to travel expenses!
This regulation was introduced as part of the Consumer Protection Directive.
